Leave Arrangements for Work/Family/Personal Life Balance

Miscellaneous Leave
(Including Court, Military and Special Leave)

Academic and General Staff

Staff can take miscellaneous leave for a number of reasons such as those listed below:

  • To attend court for jury service;
  • If they are a member of the Defence Reserve Force, to attend an annual training camp and up to two classes or courses of instruction each year;
  • If they are a member of a voluntary organisation, to assist in emergencies where the organisation is called upon to assist by the government or by a competent authority under the State Disaster Plan;
  • Where the employee responds to a call for volunteers to meet a declared bushfire or other emergency;
  • If an employee is a candidate for election to Federal or State Parliament they are entitled to leave without pay to contest an election.

Please note that these entitlements may vary depending on the negotiated terms of your Australian Workplace Agreement.

Leave provisions are outlined in the Collective Agreement for Academic and General Staff or in their Australian Workplace Agreement.

For those staff on Australian Workplace Agreements leave entitlements are the same as those stipulated in the Collective Agreement.

TAFE Teaching Staff

Subject to operational requirements the University may grant leave with or without pay on terms and conditions agreed upon by the University and the Employee.

TAFE Teachers are also entitled to leave to attend Court or Military Leave subject to the provision of satisfactory evidence.

Please note the 'provisions/entitlements' above do not apply to casual or sessional staff members.

How to apply for Miscellaneous Leave
  • Fully understand your miscellaneous leave entitlements and options.
  • See links below and/or discuss your situation and plans confidentially with Human Resources (Richelle Brehaut, Human Resources Co-ordinator, x9367 or r.brehaut@ballarat.edu.au) and/or with your Supervisor.
  • Complete and submit a Leave Absentee Form.

Clause 56 Miscellaneous Leave

56.1 An employee is entitled to paid leave in the following circumstances:

  • to attend court for the purpose of jury service;
  • if a member of the Defence Reserve Force, to attend an annual training camp and up to two classes or courses of instruction each year;
  • if a member of a voluntary organisation, to assist in emergencies where the organisation is called upon to assist by the government or by a competent authority under the State Disaster Plan;
  • where the employee responds to a call for volunteers to meet a declared bushfire or other emergency;

56.2 An employee is entitled to leave without pay to contest an election where the employee is a candidate for election to Federal or State Parliament

56.3 The conditions attached to the above entitlements are contained in University policies.


Court Attendance Leave - TAFE Teaching Staff
TAFE Teachers' Conditions of Employment (Victoria) Award 2002 Clause 24

24.1 An employee required to appear and serve as a juror in any court shall be granted leave at the ordinary rate of pay for the period during which the attendance of the employee at court is required.

24.2 An employee under a subpoena or order, shall be entitled to attend the relevant jurisdiction as part of their official duties, without loss of pay.

24.3 To obtain approval for leave under this clause, a leave application must be supported by a copy of the notification that the employee has attended the court.


Military Leave - TAFE Teaching Staff
TAFE Teachers' Conditions of Employment (Victoria) Award 2002 Clause 25

25.1 Leave of absence without loss of pay may be granted for two weeks in any year to a teacher who is a voluntary member of the Citizens' Forces for the purpose of attending annual training and a further four days a year for the same purpose on the certification of the Commanding Officer of the particular service unit concerned.

25.2 Applications for paid military leave shall be submitted for approval to the employer and satisfactory evidence of attendance at the annual training, shall be forwarded on resumption of duty.


Special Leave - TAFE Teaching Staff
TAFE Teachers' Conditions of Employment (Victoria) Award 2002 Clause 31

31.1 Subject to the operational requirement of the employer, the employer may grant the employee such other leave with or without pay and on such terms and conditions as agreed between the employer and the employee.

31.2 The granting of leave under this clause where an employee has accrued but not taken annual leave credits, shall be at the employer's discretion.
